Terms of Service

1. Acceptance of Terms

By accessing or using CareerCraft AI Jobs ("the Platform"), available at careercraft.cc/hire, you agree to be bound by these Terms of Service ("Terms"). If you are accepting these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms. If you do not agree to these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you ("Recruiter," "You," or "User") and JV ELECTROMECH, a Sole Proprietorship registered in India ("Company," "We," "Us," or "Our").

2. Account Registration

2.1 Account Types

The Platform offers two types of accounts:

• Individual Recruiter Account: For independent recruiters, staffing consultants, and HR professionals seeking to post jobs and access the CV Bank on their own behalf.
• Company Account: For organisations that wish to manage multiple recruiters, team roles, and consolidated billing under a single company profile.

2.2 Registration Requirements

You must provide accurate, current, and complete information during the registration process, including your legal name, valid email address, contact number, and — for Company Accounts — company registration details. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.3 Eligibility

You must be at least 18 years of age and legally competent to enter into a binding contract under Indian law. Accounts created using automated means, false identities, or for fraudulent purposes will be terminated immediately without notice.

3. Subscription Plans & Billing

3.1 Plans

The Platform offers subscription plans with varying features, job posting limits, and CV Bank credits. Details of currently available plans are published on the Platform's pricing page and may be updated from time to time at our sole discretion.

3.2 Auto-Renewal

All subscription plans renew automatically at the end of each billing cycle (monthly or annual, as selected) unless cancelled prior to the renewal date. You will be charged the then-current subscription fee at the time of renewal. We will send a reminder notification at least 3 days before each renewal.

3.3 Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period. No partial or prorated refunds will be issued for the remaining period.

3.4 Price Changes

We reserve the right to modify subscription pricing. Existing subscribers will be notified at least 30 days before any price change takes effect. Continued use of the Platform after the effective date constitutes acceptance of the new pricing.

4. Per-Vacancy Pricing

Certain plans include per-vacancy pricing, where you are charged for each individual job posting beyond your plan's included quota. Per-vacancy charges are billed at the time of job publication. The applicable per-vacancy rate is displayed during the job posting flow and is subject to change with 15 days' prior notice.

Once a per-vacancy charge has been processed and the job has been published, it is non-refundable. See our Refund Policy for exceptions.

5. CV Bank Usage

5.1 Credits

Access to the CV Bank is governed by a credit-based system. Each subscription plan includes a specified number of CV view credits per billing cycle. Additional credits may be purchased separately as credit packs.

5.2 Fair Use

CV Bank access is provided for legitimate recruitment purposes only. You agree not to:

• Use automated tools, bots, scrapers, or scripts to extract candidate data from the CV Bank.
• Download, copy, or redistribute candidate CVs or personal data in bulk.
• Share your CV Bank access credentials with unauthorised third parties.
• Use candidate data for any purpose other than evaluating candidates for specific job opportunities.

5.3 Data Protection

Candidate data accessed through the CV Bank is provided under strict data protection obligations. You acknowledge that you are a data controller for any candidate data you access and process, and you agree to handle such data in compliance with applicable data protection laws, including the Digital Personal Data Protection Act, 2023 (India) and the GDPR where applicable.

6. Job Posting Guidelines

All job postings on the Platform must comply with the following requirements:

• Accuracy: Job descriptions must accurately represent the position, responsibilities, qualifications, compensation, and working conditions.
• Non-Discrimination: Job postings must not discriminate on the basis of race, colour, religion, gender, sexual orientation, national origin, age, disability, caste, or any other protected characteristic under applicable law.
• Legitimate Opportunities: All postings must represent genuine employment opportunities. Postings for pyramid schemes, multi-level marketing, or purely commission-based roles without base compensation must be clearly disclosed as such.
• Prohibited Content: Job postings must not contain obscene, defamatory, misleading, or illegal content. Postings requiring candidates to pay fees for employment or training are strictly prohibited.

We reserve the right to review, modify, or remove any job posting that violates these guidelines without prior notice.

7. AI Features Disclaimer

You, as the recruiter or hiring manager, bear sole responsibility for reviewing, editing, and approving all AI-generated content before it is published or acted upon. The Company makes no warranties regarding the accuracy, completeness, suitability, or legal compliance of AI-generated outputs. AI-powered candidate matching and ranking are based on algorithmic analysis and do not constitute employment recommendations.

8. Intellectual Property

All content, features, functionality, trademarks, logos, and design elements of the Platform are the exclusive property of JV ELECTROMECH and are protected under applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent.

You retain ownership of the content you submit to the Platform, including job descriptions and company profiles. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute such content solely for the purpose of operating and promoting the Platform.

9. Data Protection & GDPR Compliance

We are committed to protecting personal data in accordance with applicable privacy laws, including the General Data Protection Regulation (GDPR) for users in the European Economic Area and the Digital Personal Data Protection Act, 2023 (India).

Our data processing practices are detailed in our Privacy Policy. By using the Platform, you consent to the collection, processing, and storage of your data as described therein.

9.1 Candidate Privacy

Candidate CVs and personal data in the CV Bank are provided on a consent basis. Candidate profiles are displayed with anonymised previews until credits are used to reveal full contact information. You must respect candidate privacy preferences and opt-out requests. Misuse of candidate personal data may result in immediate account termination and legal action.

10. Payment Terms

10.1 Payment Processing

All payments are processed securely through Razorpay, our authorised payment gateway. We accept credit cards, debit cards, UPI, net banking, and other payment methods supported by Razorpay. Payment processing is subject to Razorpay's terms of service.

10.2 GST

All prices displayed on the Platform are exclusive of Goods and Services Tax (GST) unless explicitly stated otherwise. GST at the applicable rate (currently 18%) will be added to your invoice. Our GSTIN is 36ANSPB3259K1ZM.

10.3 Invoicing

A GST-compliant tax invoice will be generated and made available in your account dashboard after each successful payment. Invoices can be downloaded in PDF format at any time from the billing section of your account.

11. Limitation of Liability

To the maximum extent permitted by applicable law, JV ELECTROMECH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the Platform.

Our total aggregate liability for any claim arising out of or relating to these Terms or the Platform shall not exceed the total amount paid by you to us in the twelve (12) months immediately preceding the event giving rise to such liability.

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Termination

We may suspend or terminate your account at any time, with or without cause, upon reasonable notice. Grounds for immediate termination without notice include:

• Violation of these Terms or any applicable law.
• Fraudulent or abusive use of the Platform.
• Scraping, harvesting, or unauthorised extraction of CV Bank data.
• Posting discriminatory, misleading, or prohibited content.
• Non-payment of fees after reasonable notice and cure period.

Upon termination, your right to access the Platform ceases immediately. Data associated with your account will be retained for a period of 90 days, after which it will be permanently deleted unless retention is required by law.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Telangana, India.

Before initiating any legal proceedings, the parties agree to attempt to resolve disputes amicably through negotiation for a period of not less than 30 days.

14. Modifications

We reserve the right to update or modify these Terms at any time. Material changes will be notified via email or a prominent notice on the Platform at least 15 days before they take effect. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.
